Entran II Heatway Hose Class Action Settlement

On November 2, 2004, a Canadian Superior Court judge for the province of Ontario, the Honorable Justice Winkler, granted final approval to a class action settlement regarding whether the Goodyear Tire & Rubber Company made defective Entran II hose. As a result, the deadlines to submit a request to Re-Join the Settlement, exclude yourself from the Settlement, object to the Settlement, appear at the Approval or Fees/Expenses Hearing for the Settlement ARE NOW PAST.

The deadline for filing a Claim Form is November 19, 2009. Class Members must submit a Claim Form to get payment. Filing a Claim Form is free. It is unnecessary to hire a third-party service to file a claim for you, because filing a Claim Form is free. Previously, in June 2004, the Settlement was modified and expanded to include present or former Entran II property owners in Canada and all 50 United States and its territories and possessions. Also as a result of the amendment, the Settlement Fund was increased to $300 million. Some Class Members may now receive 50% or more of the cost of remediation.

Plaintiffs allege Defendant manufactured defective Entran II hose. The product was used in radiant heating and snow melting systems. For complete information regarding your rights and options as a Class Member, you should read the Notice of Expanded and Modified Settlement (Long Form Notice).

You are a Class Member if:

You own or owned property in Canada

AND

Entran II hose made by Goodyear was or is used for a radiant heating system on the property. To see if you have Entran II, click here.

You submit a valid Claim Form no later than November 19, 2009.

Exclude Yourself	You get no payment. This is the only choice that will allow you to sue Goodyear on your own about the claims. The instructions for Class Members who want to opt out are contained in the Notice of Expanded and Modified Settlement (Long Form Notice).	Deadline: September 10, 2004
Object	If you don’t like some part of the settlement and wish to object, you must mail your objection. Objections must be mailed and postmarked by September 10, 2004. Approval Hearing	A settlement hearing will be held on October 26, 2004 at 10 a.m. in at the Ontario Superior Court of Justice, 361 University Avenue, Toronto, Ontario M5G 1T3.	October 26, 2004
Fees / Expenses Hearing	A hearing to consider Class Counsel’s fees and expenses will be held on November 8, 2004 at 10 a.m. in at the United States District Court for the District of New Jersey, 402 East State Street, Room 2020, Trenton, N.J. 08608.	November 8, 2004
Do Nothing	You get no payment. And, you give up your right to sue Goodyear on these claims later.

What Does the Settlement Provide to Class Members?
If you qualify, Goodyear has agreed to pay a total US$300 million into a Fund to pay to Class Members in Canada and individuals who submit a valid Claim Form.
