On November 17, 2004, New Jersey District Court Judge Stanley Chesler granted final approval to a class action settlement regarding whether the Goodyear Tire & Rubber Company made defective Entran II hose. As a result, the deadlines to submit a request to Re-Join the Settlement, exclude yourself from the Settlement, object to the Settlement, appear at the Approval or Fees/Expenses Hearing for the Settlement ARE NOW PAST.

The deadline for filing a Claim Form is November 19, 2009. Class Members must submit a Claim Form to get payment. Filing a Claim Form is free. If you have any questions about filing a Claim Form, please contact the court-approved Entran II Settlement Claims Administrator by calling 1-800-254-9222.

Previously, in June 2004, the Settlement was modified and expanded to include present or former Entran II property owners in all 50 United States and its territories and possessions and in Canada. The Settlement Fund is now $300 million.

Plaintiffs allege Defendant manufactured defective Entran II hose. The product was used in radiant heating and snow melting systems. For complete information regarding your rights and options as a Class Member, you should read the Notice of Expanded and Modified Settlement (Long Form Notice).

You are a Class Member if:

  • You own or owned property in any state or U.S. territory.

AND

  • Entran II hose made by Goodyear was or is used for a radiant heating system on the property. To see if you have Entran II, click here.

AND

  • You submit a valid Claim Form no later than November 19, 2009.

Submit a Request to Re-Join If you filed a Request for Exclusion from the October 8, 2003 Settlement you can withdraw that Request for Exclusion and submit a Request to Re-Join this Amended Settlement.

Exclude Yourself You get no payment. This is the only choice that will allow you to sue Goodyear on your own about the claims. The instructions for Class Members who want to opt out are contained in the Notice of Expanded and Modified Settlement (Long Form Notice).

Object If you don’t like some part of the settlement and wish to object, you must mail your objection. Objections must be mailed and postmarked by September 10, 2004. The instructions for Class Members who want to object are contained in the Notice of Expanded and Modified Settlement (Long Form Notice).

Appear at a Hearing You can ask to speak to the Court about the fairness of the settlement. Instructions are contained in the Notice of Expanded and Modified Settlement (Long Form Notice).

Do Nothing You get no payment. And, you give up your right to sue Goodyear on these claims later.    

What Does the Settlement Provide to Class Members?
If you qualify, Goodyear has agreed to pay a total $300 million into a Fund to pay to Class Members in the United States and Canada who submit a valid Claim Form. As an estimate, some Class Members may receive 50% or more of the cost of remediation of their Entran II hose. (For complete information, see Amended Plan of Allocation and Distribution.)
